These Terms of Service define the rights and obligations between the customer and SIA CONSTRUCTIONE VIVENTE when using shopvivente.com and purchasing products from VIVENTE.

2. About VIVENTE

VIVENTE creates and offers refined interior objects inspired by sacred geometry, architecture, proportion and natural materials. Products may include natural stone objects, wooden objects, stone slab counters and related design objects.

Because natural materials are used, each item may have unique variations in tone, texture, grain, mineral pattern, colour and surface character. These natural differences are not considered defects.

3. Use of the Website

By using this website, you agree to use it only for lawful purposes and in accordance with these Terms.

You may not:

  • Use the website in a way that may damage or interrupt its operation;

  • Attempt to gain unauthorised access to the website or its systems;

  • Copy, reproduce or commercially use website content without permission;

  • Provide false, misleading or incomplete information when placing an order.

4. Products and Product Information

We make reasonable efforts to display product descriptions, images, dimensions, materials and pricing accurately.

However:

  • Product colours may vary depending on screen settings;

  • Natural stone and wood may differ from images due to natural variation;

  • Handmade, carved or material-based objects may have small visual differences;

  • Product availability may change;

  • Some products may be made to order or require individual production and delivery arrangements.

If a product is unavailable after an order is placed, we will contact you and offer a solution, replacement, later delivery date or refund.

5. Prices and Taxes

All prices are displayed in euros unless stated otherwise.

Prices may include VAT where applicable. Shipping costs, customs fees, import duties or other additional charges may be calculated separately, depending on the delivery destination and order type.

For deliveries outside the European Union, the customer may be responsible for customs duties, import VAT, taxes or other local charges.

6. Orders

An order is placed when the customer completes the checkout process and receives an order confirmation.

We reserve the right to refuse or cancel an order if:

  • The product is unavailable;

  • The payment is not completed;

  • The order information is incorrect or incomplete;

  • There is a pricing or technical error;

  • The order appears fraudulent or unlawful;

  • Delivery to the requested destination is not possible.

If payment has already been made and the order is cancelled by us, we will refund the relevant amount.

7. Payment

Payment must be completed using the available payment methods shown at checkout.

The order may be processed only after payment has been successfully received or confirmed.

We do not store full payment card details. Payments are handled by third-party payment providers.

8. Shipping and Delivery

Shipping terms are described in our Shipping Policy.

Delivery times are estimates and may vary depending on product availability, production time, courier operations, customs processes and destination.

For high-value, fragile, heavy or custom objects, delivery may require individual coordination.

9. Right of Withdrawal

If you are a consumer in the European Union, you generally have the right to withdraw from a distance purchase within 14 days without giving a reason.

The withdrawal period expires after 14 days from the day on which you, or a third party indicated by you other than the carrier, receives the goods.

To exercise the right of withdrawal, you must inform us by email:

Your notice should include:

  • Name and surname;

  • Order number;

  • Product name;

  • Date of purchase;

  • Date of receipt;

  • Clear statement that you wish to withdraw from the purchase.

You may use a free-form statement, provided it clearly expresses your decision to withdraw.

10. Returning Goods After Withdrawal

If you exercise the right of withdrawal, you must return the goods without undue delay and no later than 14 days from the day you informed us of your decision to withdraw.

Unless otherwise agreed, the customer is responsible for return shipping costs.

Returned goods must be unused, undamaged and safely packed. The customer is responsible for maintaining the quality and safety of the goods during the withdrawal period.

The customer may inspect the goods only to the extent necessary to determine their nature, characteristics and functioning, similar to how this would be possible in a physical store. If the goods are used beyond this extent and their value is reduced, we may deduct the loss in value from the refund.

11. Exceptions to the Right of Withdrawal

The right of withdrawal may not apply in certain cases provided by law, including, but not limited to:

  • Goods made to the customer’s specifications;

  • Personalised or custom-made goods;

  • Products produced or modified specifically for the customer;

  • Individually ordered stone slabs, counters or custom material objects;

  • Goods that cannot be returned due to their nature after production or installation has started, where legally applicable.

If a product is made to order, customised or produced according to your individual requirements, this will be communicated before or during the order process.

12. Refunds

If you withdraw from the purchase in accordance with these Terms, we will refund the payment received for the returned goods without undue delay and no later than 14 days from the day we receive your withdrawal notice.

However, we may withhold the refund until we have received the goods back or until you have provided proof that the goods have been returned.

Refunds are made using the same payment method used for the original transaction, unless otherwise agreed.

Original shipping costs may be refunded only to the extent required by applicable law. Additional delivery costs chosen by the customer, such as express, special handling or premium delivery, may not be refundable.

13. Damaged or Incorrect Goods

If your order arrives damaged or incorrect, please contact us as soon as possible at info@buvprojekti.lv.

Please include:

  • Order number;

  • Description of the issue;

  • Photos of the product;

  • Photos of the packaging;

  • Delivery documentation, if available.

We will review the situation and offer a suitable solution, such as repair, replacement, partial refund, return or refund, depending on the circumstances and applicable law.

14. Product Warranty and Legal Rights

Customers have rights under applicable consumer protection laws regarding goods that do not conform to the contract.

These Terms do not limit any mandatory rights you may have under Latvian or European Union consumer protection law.

15. Intellectual Property

All content on this website, including text, images, design, product concepts, graphics, logos, layouts and visual materials, belongs to VIVENTE or its licensors unless stated otherwise.

You may not copy, reproduce, distribute, modify or commercially use any website content without prior written permission.

16. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  • Indirect or consequential losses;

  • Loss of profit, revenue or business opportunity;

  • Delays caused by courier, customs or force majeure circumstances;

  • Differences in natural material tone, pattern, texture or grain;

  • Damage caused by incorrect installation, use, storage or maintenance by the customer;

  • Technical interruptions of the website caused by third-party service providers.

Nothing in these Terms excludes liability where such exclusion is not permitted by law.

17. Force Majeure

We are not responsible for delays or failure to fulfil obligations caused by circumstances beyond our reasonable control, including natural disasters, war, strikes, transport disruptions, customs delays, supplier delays, technical failures, government restrictions or other force majeure events.

18. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Latvia.

Any disputes should first be resolved through mutual negotiation. If no agreement is reached, disputes shall be resolved in accordance with the laws and procedures applicable in Latvia.

Consumers may also have the right to contact the Consumer Rights Protection Centre of Latvia or use other consumer dispute resolution mechanisms available under applicable law.

We may update these Terms from time to time. The latest version will always be available on this page.
